These Terms of Service (“Terms”) are a binding agreement between you and Fous Technologies, Inc., a Delaware corporation doing business as Fous (“Fous,” “we,” “us,” or “our”). These Terms govern your access to and use of fous.com, the Fous application, and any related websites, applications, APIs, models, documentation, features, or services that link to these Terms (collectively, the “Service”).
By creating an account, accessing the Service, uploading a photograph, or otherwise using the Service, you agree to these Terms. If you do not agree to these Terms, you may not use the Service.
1. Eligibility and authority
You must be at least 16 years old to use the Service. If you are under 16, you may not create an account, upload images, or otherwise use the Service.
You may not use the Service if you are prohibited from doing so under applicable law, if you are located in or ordinarily resident in a country or territory subject to comprehensive U.S. sanctions, or if you are listed on any U.S. or other applicable sanctions or denied-parties list.
If you use the Service on behalf of a company, organization, government entity, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In that case, “you” includes both you and that entity.
2. Accounts and security
You are responsible for your account and for all activity that occurs under it. You must provide accurate account information, keep your sign-in credentials secure, and promptly notify us at hello@fous.com if you believe your account has been accessed without authorization.
You may not sell, transfer, sublicense, share, or make your account available to another person or entity without our prior written consent. We may refuse registration, require additional verification, limit access, or disable accounts where we believe doing so is necessary to protect the Service, users, affected people, or the public.
3. Experimental nature of the Service
Fous is offered as an experimental research preview. The Service attempts to estimate likely real-world coordinates from visual information in a submitted image, currently within a limited geographic area. The Service is probabilistic and may return incorrect, incomplete, outdated, misleading, unavailable, or unrelated results.
You understand and agree that:
- the Service is provided as is and as available, without service-level commitments;
- we may add, remove, suspend, throttle, restrict, modify, or discontinue any part of the Service at any time;
- submissions from outside the supported area may return no result, an inaccurate result, or an unrelated result;
- outputs are estimates only and must be independently verified before being relied on; and
- the Service is not designed or approved for emergency, safety-critical, legal, law-enforcement, immigration, employment, housing, credit, insurance, medical, or other consequential decisions.
4. Permitted uses
Subject to these Terms, you may use the Service only for lawful, responsible purposes, including:
- identifying or verifying the location of photographs you took yourself or otherwise have lawful authority to analyze;
- analyzing public places, public architecture, public artwork, public events, or other public-interest material in a way that does not target a private individual, household, or vulnerable community;
- academic research, education, journalism, or fact-checking conducted lawfully and with appropriate privacy and safety safeguards;
- disputing or verifying location claims about public images, provided your use does not identify, locate, profile, or endanger a specific person; and
- personal curiosity about your own photographs or photographs you have lawful permission to analyze.
These examples do not authorize any use that is prohibited by these Terms or by applicable law.
5. Prohibited uses
You may not use the Service, directly or indirectly, and may not assist anyone else in using the Service, to:
- identify, locate, track, surveil, profile, harass, intimidate, threaten, dox, exploit, defame, or harm any individual person, household, or vulnerable community;
- determine or infer where a specific person lives, works, sleeps, worships, attends school, seeks shelter, obtains medical care, receives social services, meets others, or otherwise spends private time;
- process images of a person in a private setting or in any context where the person has a reasonable expectation of privacy;
- process images of minors in any context that could be used to identify, locate, track, contact, exploit, or harm them;
- target survivors of domestic violence, stalking, trafficking, sexual assault, hate crimes, political repression, or other vulnerable people or groups;
- identify, expose, or confirm sensitive locations, including homes, shelters, schools, hospitals, clinics, reproductive-health facilities, places of worship, immigration services, crisis centers, political organizing spaces, or other locations where disclosure could create a safety risk;
- support stalking, domestic violence, doxxing, targeted harassment, vigilantism, blackmail, extortion, discrimination, political repression, or physical, financial, emotional, or reputational harm;
- conduct mass surveillance, build dossiers, aggregate location intelligence, or enrich profiles about individuals, households, activists, journalists, protesters, public officials, religious communities, political groups, or other communities;
- use the Service for law-enforcement, intelligence, military, immigration, private-investigation, bounty-hunting, debt-collection, employment-screening, tenant-screening, insurance, credit, or security-vetting purposes without our prior written approval and all legally required authority;
- submit content you do not have all necessary rights, permissions, and legal bases to submit;
- submit content obtained through theft, hacking, unauthorized access, scraping of protected services, breach of confidence, unlawful surveillance, or violation of another service’s terms;
- submit malware, exploit code, deceptive inputs, adversarial inputs, or content designed to test, bypass, manipulate, or degrade safety, security, or abuse-detection systems;
- use the Service in furtherance of any crime, tort, privacy violation, intellectual-property infringement, contractual breach, unlawful discrimination, sanctions violation, export-control violation, or other unlawful activity;
- resell, sublicense, distribute, provide, repackage, embed, or expose the Service or its outputs to third parties as a product, dataset, API, feature, or service without our prior written agreement;
- scrape, crawl, mirror, benchmark, bulk query, load test, or access the Service through automated means except as expressly permitted by us in writing;
- bypass or attempt to bypass authentication, rate limits, geofencing, account-creation controls, abuse detection, safety filters, logging, or any other technical or administrative protection;
- probe, scan, or test the vulnerability of the Service or any related system or network without our prior written authorization;
- interfere with, disrupt, overload, or degrade the Service or any related system or network;
- reverse engineer, decompile, disassemble, copy, extract, or attempt to discover any underlying source code, internal interfaces, or proprietary technology of the Service; or
- use the Service, submissions, outputs, or metadata to train, fine-tune, evaluate, distill, improve, or otherwise inform another model, dataset, mapping product, geolocation system, or surveillance tool without our prior written agreement.
6. Submissions
“Submissions” means photographs, images, files, prompts, parameters, metadata, reports, feedback, communications, and other content or information you submit to or through the Service.
You retain whatever ownership rights you have in your Submissions. By submitting a Submission, you grant Fous a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, process, transmit, analyze, review, display, and otherwise use the Submission and associated metadata solely to:
- provide, operate, maintain, and secure the Service;
- process your request and generate, store, and display outputs;
- debug failures and improve reliability, safety, and abuse controls;
- detect, prevent, investigate, and respond to suspected misuse;
- enforce these Terms and our policies;
- comply with law, legal process, and governmental requests; and
- establish, exercise, or defend legal claims.
This license lasts for as long as we retain the relevant Submission under our Privacy Policy. We do not use submitted images to train the Fous location model unless we first update our Privacy Policy and obtain consent where required by law.
7. Submission representations
You represent, warrant, and agree that:
- you have all rights, permissions, consents, and legal bases necessary to submit each Submission and grant the license in Section 6;
- your Submissions and use of the Service do not violate privacy, publicity, copyright, confidentiality, contractual, property, data protection, or other rights of any person;
- your Submissions were not obtained through unauthorized access, theft, hacking, scraping of protected services, breach of confidence, unlawful surveillance, or other improper means;
- your use of the Service complies with all laws applicable to you, your Submissions, the people or places depicted or implicated by your Submissions, and the jurisdiction where you use the Service;
- you will not misrepresent the source, authorization, context, or purpose of any Submission; and
- you will not provide access to the Service to anyone who is prohibited from using it under these Terms.
8. Outputs
The Service may generate coordinates, candidate locations, maps, confidence scores, explanations, or other results (“Outputs”). Outputs are estimates only. They may be wrong, incomplete, outdated, or misleading.
You are solely responsible for how you interpret, verify, store, disclose, and use Outputs. You may not use Outputs for any prohibited purpose. You may not present Outputs as verified facts unless you have independently verified them through reliable sources.
We may refuse to provide, remove, alter, watermark, delay, throttle, or withhold Outputs where we believe doing so is necessary to protect safety, prevent abuse, comply with law, or enforce these Terms.
9. Privacy, logging, and safety review
Our Privacy Policy explains how we collect, use, disclose, and retain information. By using the Service, you acknowledge that Fous logs uploads, outputs, account identifiers, IP addresses, user-agent strings, request parameters, timestamps, abuse-filter decisions, and other operational information for security, safety, abuse prevention, debugging, legal compliance, and enforcement.
We may use automated systems and manual review to detect misuse, enforce rate limits, evaluate safety risks, and investigate suspected violations. Review may include Submissions, Outputs, metadata, account history, network signals, and communications with us.
10. Enforcement
We may, in our sole discretion and without prior notice, take any action we consider appropriate to enforce these Terms or protect Fous, the Service, users, affected people, or the public, including:
- refusing, blocking, throttling, delaying, or removing Submissions or Outputs;
- limiting, suspending, or terminating access to the Service;
- disabling, deleting, or refusing to create accounts;
- preserving Submissions, Outputs, metadata, logs, and communications as evidence;
- manually reviewing Submissions, Outputs, metadata, and account activity;
- reporting suspected unlawful conduct, safety threats, or emergencies to law enforcement, regulators, affected parties, platforms, service providers, or other appropriate authorities; and
- cooperating with civil, criminal, regulatory, or safety investigations, including by responding to subpoenas, court orders, preservation requests, and other lawful processes.
We are not required to explain every enforcement decision. Termination or suspension does not entitle you to compensation, restoration of access, or return of prior Submissions, except where required by law.
11. Fous intellectual property
The Service, including all related software, technology, designs, interfaces, documentation, branding, trademarks, trade names, and other intellectual property, is owned by Fous or its licensors.
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal or internal business purposes. No other rights are granted, whether by estoppel, implication, or otherwise. Fous reserves all rights not expressly granted in these Terms. The Fous name, logo, and visual identity may not be used without our prior written consent.
12. Feedback
If you send us suggestions, ideas, comments, improvements, or other feedback about the Service (“Feedback”), you grant Fous a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable license to use, modify, exploit, and incorporate that Feedback for any purpose, without obligation, attribution, or compensation to you. You waive any moral rights in Feedback to the maximum extent permitted by law.
13. Third-party services
The Service depends on third-party providers (including providers of cloud hosting, object storage, transactional email, single-sign-on, and related infrastructure) and may link to, interoperate with, or display content from third-party services such as mapping platforms. We do not control and are not responsible for the acts, omissions, content, availability, or terms of any third-party service. Your use of any third-party service is governed by that service’s own terms and privacy policies.
14. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE, SUBMISSIONS HANDLING, AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS, AND WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. FOUS, ITS AFFILIATES, AND ITS LICENSORS, SUPPLIERS, AND SERVICE PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AVAILABILITY, COMPLETENESS, QUIET ENJOYMENT, TITLE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, FOUS MAKES NO REPRESENTATION OR WARRANTY THAT (A) ANY OUTPUT WILL CORRESPOND TO THE LOCATION WHERE A PHOTOGRAPH WAS ACTUALLY TAKEN; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; OR (D) ANY DEFECT WILL BE CORRECTED. YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK AND ARE SOLELY RESPONSIBLE FOR ANY HARM YOU OR OTHERS SUFFER AS A RESULT OF YOUR USE.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FOUS, ITS AFFILIATES, OR ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, REPUTATION, OPPORTUNITY, OR PRIVACY, OR FOR PERSONAL INJURY, EMOTIONAL DISTRESS, BUSINESS INTERRUPTION, OR LOSS OR HARM CAUSED BY THIRD PARTIES OR USE OF OUTPUTS, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR OTHERWISE, AND EVEN IF FOUS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL CUMULATIVE LIABILITY OF FOUS AND ITS AFFILIATES UNDER OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE ACTUALLY PAID FOUS FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT FIRST GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100 USD).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. IN THOSE JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. THE LIMITATIONS IN THIS SECTION FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND FOUS.
16. Indemnification
You agree to defend, indemnify, and hold harmless Fous, its affiliates, and their respective officers, directors, employees, agents, representatives, licensors, and service providers from and against any and all claims, demands, investigations, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to (a) your access to or use of the Service; (b) any Submission you make through the Service; (c) any Output you generate or use through the Service; (d) your violation of these Terms; (e) your violation of any law; or (f) your infringement, misappropriation, or violation of any right of any third party, including any person depicted in or implicated by your Submissions. We may, at our option, assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with our defense.
17. Suspension and termination
We may suspend, restrict, or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by emailing hello@fous.com.
Upon termination, all rights granted to you under these Terms cease immediately. Sections that by their nature should survive termination, including Sections 5, 6, 7, 8, 9, 10, 11, 12, 14, 15, 16, 19, and 20, will survive.
18. Modifications to the Service or Terms
We may modify these Terms at any time. The current version will always be posted on this page, and the “Last updated” date will reflect the most recent changes. Material changes will be highlighted where we consider it appropriate. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.
We may also modify, suspend, or discontinue any part of the Service at any time, with or without notice, and we will not be liable to you or any third party for doing so.
19. Governing law and disputes
These Terms and any dispute arising out of or relating to them or to the Service are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You and Fous agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, USA, and each party irrevocably consents to the personal jurisdiction and venue of those courts. You and Fous each waive, to the maximum extent permitted by law, any right to a jury trial and any right to bring or participate in a class action, collective action, or other representative proceeding against the other.
Any claim arising out of or relating to these Terms or the Service must be filed within one (1) year after the claim arose; otherwise, the claim is permanently barred.
20. Miscellaneous
These Terms, together with the Privacy Policy and any other policies referenced from the Service, constitute the entire agreement between you and Fous concerning the Service and supersede all prior or contemporaneous agreements on the subject.
If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect. Our failure to enforce any provision will not be a waiver of that provision or of our right to enforce it later.
You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent, and any purported assignment without that consent is void. We may assign these Terms at any time, including in connection with a merger, acquisition, financing, reorganization, or sale of assets. These Terms do not create any third-party beneficiary rights.
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, war, terrorism, civil disturbance, labor disputes, infrastructure outages, government action, or natural disasters. Headings are for convenience only and do not affect interpretation.
By using the Service, you consent to receive notices and communications from us electronically, including by email and through the Service. Notices to Fous must be sent to hello@fous.com.
